This kind of compensation is often paid by the seller to the agent and is an additional expense for the seller. On 1st October 2020, Kim of Manchester consigned goods costing $50,000 to Harry of Bristol. On 31 December 2020, an account sales was received from Harry showing that all the goods were sold for $75,000 – out of which, $20,000 were sold on credit. The agent is not liable for all other disputes arising out of the contract between the principal and the customer. For example, if the buyer withheld payment because of quality issues or late delivery, the agent will not be liable.

A del credere agent is a combination of a salesperson and an insurance firm. The agent is liable, however, only when the third party fails to carry out their contract, e.g., by insolvency. The agent is not liable to the principal if the third party refuses to carry out the contract, for example if the buyer refuses to take delivery.

Calculation of del credere commission

A Del Credere Agent not only establishes privity of contract between the principal and the third party but also guarantees to the principal the due performance of the contract by the third party. The agent who guarantees the solvency of the buyers is called a del credit agent. When of commission is given, the consignee undertakes upon himself the risk of any bad debts arising out of the credit.

The meaning of del credere originated from Italy during the Middle Ages and means belief or trust. Understanding the liabilities and the limitations of the del credere agency will be beneficial when appointing an agent or broker. Since the entry for recording all commissions is the same, a single entry for the total amount may be recorded. Where there is a specific method agreed upon to calculate a type of commission, that has to be followed.

Where any of these commissions are given as a % and in the absence of information to the contrary, it is conventionally calculated as a % of gross sale proceeds. The consignee, selling the goods on consignment basis is entitled, as remuneration, to a commission on sales. This commission may take different forms depending on the agreement between the Consignor and the Consignee. Note that a del credere agency agreement does not need to be in writing, as it may be inferred from the parties’ conduct during the course of the business. If the agent sells the goods of Rs. 45,000, find the total earning of the agent.

Meaning of del credere agent in English

Generally, it is calculated on total sales i.e. sum of cash sales and credit sales. A del credere commission is a type of commission that a factor receives for guaranteeing payment to the principal of all debts that become due through the agency relationship. This means that the factor takes on extra responsibility and risk, and is compensated accordingly with a higher commission. Del credere commission is allowed by the consignor to the consignee for taking responsibility for the bad debts that may arise.

However, the consignor and consignee may sign a separate agreement regarding the calculation and payment of del credere commission. Due to the increased risk taken on by a del credere agency for bad debt, the agency often charges an additional commission, known as the ‘Del Credere Commission’. In a normal principal-agent relationship, the agent acts as a salesperson, or broker for the principal. However, a del credere agency is a type of principal-agent relationship where the agent also acts as a guarantor of credit to the buyer. The principal agent relationship between the Consignor and the Consignee is guided by the agreement between them. The type of commissions and the method to be adopted for their calculation would also be specified by the agreement.

A key point to note is that a del credere agent only becomes liable to pay the principal after the buyer defaults on payment. If the principal (seller) is unable to collect for some other reason, such as a dispute over the goods delivered, the del credere agent is not liable. If the buyer is unable to pay the bill after the transaction is completed, a del credere agent may become liable for that amount. It is an extra commission given
to an agent who undertakes to
indemnify his principal against
bad debts in respect to the
goods sold on credit by the
agent. It is a way for sellers to protect themselves from the risk of non-payment by buyers, and for agents to earn a fee for providing this protection. Del credere commission is a type of commission paid to a buyer’s agent or a commission agency in exchange for taking on the buyer’s credit risk.

What Is a Del Credere Agency?

It is a commission that is paid as direct commission instead of paying through someone else. A del credere might choose to only work with buyers with a certain credit rating or level of solvency to better ensure they will consistently pay their bills. A del credere is an agent who guarantees the solvency of third parties with whom the agent contracts on behalf of the principal. As a token for the guaranty given, the agent receives an additional commission for sales. The promise of such an agent is almost universally held not to be within the statute of frauds. Such an agent assumes the position of a surety who is liable to his principal if the vendee make default.

This will result in minimising the information available relating to commissions. No commission can be calculated without the information relating to the basis for calculation. One of the following sets of accounts will appear in the ledger depending on the choice made relating to the quantum of information that the accounting system has to provide. The journal entries for recording various kinds of commission if being recorded at the same time, may be clubbed into a single entry by recording the net effect of the transactions.

By paying the del credere commission, the seller can mitigate their credit risk and ensure that they receive payment for their goods. An example of del credere agency is an auction house, where the auctioneer could be liable to the seller as an agent for the sales if the buyer defaults on payment. However, the del credere agents will only become liable to pay the amount owed to the principal in the event of a default, where the buyer fails to pay the seller (the principal). The amount owed to the principal is limited to the sum of the outstanding payment. No entry – when del credere commission is allowed to the consignee, the consignor has nothing to do with bad debts.

When the owner of a product, or item, wants to put it up for auction, they typically reach terms with an auction house, or auctioneer, to handle the sale. The auction house will then set rules and terms of the auction to potential bidders. Because the arrangement had the purpose of fixing competitors’ prices it was held illegal under Sherman Act § 1. The holding in Masonite thus seems to overrule partially the Supreme Court’s earlier holding in United States v. General Electric Co., 272 U.S. 476 (1926). Due to the availability of other forms of credit protection, del credere agents are not common in most modern commercial transactions. It is, in essence, a commission given to an agent in exchange for securing the buyer’s payment.

If the winning bidder cannot, or chooses not to pay the agreed-upon price, the auctioneer is within their legal rights to pursue further action to collect. The preferred option for auctioneers, as del credere agents, is to see the buyer make full restitution for the transaction. The nature of a del credere agency puts the agent in a situation where they have responsibilities connected to both the buyer and seller of the product or service in the transaction. When they sell the service or product, they also guarantee the buyer will pay for it appropriately. A del credere agency guarantees the creditworthiness of a buyer and, in case of default, assumes the risk posed to the seller. The computation of del credere commission is similar to the computation of ordinary commission.

In consignment account, del credere commission appears on the debit side along with the ordinary commission allowed to the consignee. Del-credere commission is an extra commission paid by the consignor to the consignee for undertaking authority of collection of debts. Generally, the consignee gets extra commission for sales made by him as a percentage of gross sales, over and above, he may get del-credere commission for the extra authority of debt collection. Sometimes it is decided that del-credere commission shall be permitted on credit sales only. However, in the absence of any such agreement the consignor grants del-credere commission on total sales and not merely on credit sales. If the consignee is authorised to del-credere commission, he has to bear the bad debts; if any, arising, out of credit sale of consignment goods.

A credit customer who purchased goods for $2,500 did not make payment and the debt proved bad. The Harry was entitled to an ordinary commission of 10% on gross sale proceeds. A cross check was enclosed with the account sales for the balance amount. Is a fee received by a sales agent from a principal for

Lt is calculated on total sales unless there is an agreement between the consignor and the consignee to provide it on credit sales only.
